3.1. Please read these terms carefully before using this website and App ("Site"). Your use of this Site constitutes acceptance of these terms and conditions, which take effect on the first day of use of this Site.

3.2. The Age UK East Sussex Group reserves the right to change these terms and conditions by posting the changes online. Your continued use of this Site after changes are posted constitutes your acceptance of this agreement as modified.

3.3 These terms and conditions apply to any site under the control of Age UK East Sussex and from which a link has been created to these terms and conditions.

3.4 When you sign up to the site, you will automatically receive our newsletter, you can unsubscribe from this at any time by clicking on the unsubscribe link and following the instructions.

4.1 Copyright in the material is owned by the Age UK East Sussex Group and/or its content suppliers. The Age UK East Sussex Group has made every effort to gain copyright for all written material on this Site. Any person who owns the copyright for material published on this Site, please email the Age UK East Sussex web officer.

4.2 Unauthorised use of the material including reproduction, storage, modification, distribution or publication without the prior written consent of the Age UK East Sussex Group or, where applicable, the respective copyright owner(s) is prohibited. Documents (including information, images, photos, logos, names and icons without the prior written permission of the copyright holders on this Site may not be downloaded, altered or adapted for any purpose except for personal, non-commercial use.

4.3 Should the Age UK East Sussex Group receive any complaint with regard to third party material on this Site, it will review the matter and remove material at its sole discretion. The Age UK East Sussex Group will not have any further liability to either party in such instance.

4.4 The photographs of adults or children used within this Site to illustrate the work of the Age UK East Sussex Group may be posed by models and do not in that case depict actual situations.

4.5 Materials on this Site are provided for the purposes of information or reporting only and should not be relied upon. Independent advice should be sought on financial, legal and medical matters.

4.6 A licence is required to use Intellectual Property of the Age UK East Sussex Group, including the Age UK East Sussex name and logo. The Age UK East Sussex Group is not responsible for the contents or the reliability of linked third-party websites, either to or from the Age UK East Sussex Site, and does not necessarily endorse the views expressed within them.

5.2 If you decide to access any of the third party websites linked to this Site, you do so entirely at your own risk. Any website wanting to create a link to the Age UK East Sussex Site, or to request a link to be created to them, must contact the Age UK East Sussex web officer.

6.1 If there is a conflict between these Terms and Conditions and/or specific terms of use appearing on this Site relating to specific material then the latter shall prevail.

7.1 You agree to use this Site only for lawful purposes, and in a manner which does not infringe the rights of, restrict, or inhibit the use and enjoyment of this Site by any third party. Such restriction and inhibition includes, without limitation, conduct which is unlawful or which may harass or cause distress or inconvenience to any person, the transmission of obscene or offensive material or disruption of normal flow of dialogue within this Site.

8.1 Unless otherwise requested, by posting messages on any Age UK East Sussex Site discussion board you are granting a licence to the Age UK East Sussex Group to reproduce these comments on any other part of the Site and in any other publications.

9.1 Where you are able to submit any contribution to this Site you agree, by submitting your contribution, to grant the Age UK East Sussex Group a perpetual, royalty-free, non-exclusive, sub-licenseable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution.

9.2 If you do not want to grant Age UK East Sussex the rights set out above, please do not submit your contribution to the Age UK East Sussex Group.

9.3 By submitting your contribution to the Age UK East Sussex Group you warrant that your contribution is your own original work and that you have the right to make it available to the Age UK East Sussex Group for any or all of the purposes specified above.

9.4 Furthermore, you warrant your contribution is not defamatory, does not infringe any law, you indemnify the Age UK East Sussex Group against all legal fees, damages and other expenses that may be incurred by the Age UK East Sussex Group as a result of your breach of the above warranty and waive any moral rights in your contribution for the purposes of its submission to and publication on the Site and the purposes specified above.

9.5. The Age UK East Sussex Group has the right to remove any material or posting you make on this Site at its discretion.

10.1. If these Terms and Conditions are not accepted in full, the use of this Site must be terminated immediately.

11.1 The Age UK East Sussex Group does not accept liability for any damages whatsoever, including, without limitation, indirect or consequential damages, loss of profits, or any damages whatsoever arising out of, or in connection with the use or loss of use of this Site.

12.1. While Age UK East Sussex endeavours to ensure that the Site is available 24 hours a day it is not guaranteed, and Age UK East Sussex does not warrant that the functions contained in the material in this Site will be uninterrupted or error free, that defects will be corrected, or that this Site or the server that makes it available are free of viruses or bugs.

12.2 The Age UK East Sussex Group may make changes to the materials on this Site, or to the information, products and prices described in them, at any time without notice. The materials on this Site may be out of date, and the Age UK East Sussex Group makes no commitment to update the Materials on this Site.


CENTRE MEMBERSHIPS

13.1 Acceptance of a membership application by a potential member is at the sole discretion of the Company. Proof may be required of any information given in the application. Fraudulent information given could result in the cancellation of all membership rights and lead to payment of all monies due to the Company. Upon acceptance membership of the Centre shall commence upon receipt of the joining fee (when one is applicable). A membership card will be issued upon acceptance. The card remains the property of the Company and entitles the holder to all the rights and privileges exercisable by the category of membership of the holder. The Company reserves the right to change the benefits of membership at any time at its discretion. Any change will not affect the member’s consumer rights.

13.2 Acceptance by the Company of an application for membership of the Centre shall constitute a legally binding agreement between the member and the Company, and the member agrees to be bound by rules, regulations and bylaws of the Centre which are in force at the time. All categories and types of membership shall be subject to these Terms & Conditions.

13.3 The member has the right to cancel this agreement by providing the Company with written notice within 14 days of receipt of this agreement. The Company shall refund in full all initial monies paid. However, any use of the facilities or the service before such cancellation may result in a charge being made for their use. In no other circumstances will fees be refundable.

13.4 Membership cards must be shown to gain entry to the Centre. Membership cards may only be used by the holder. Fraudulent use of the card may result in cancellation of membership with no refund being made by the Company. Lost or damaged cards may be subject to a charge for replacement.

LIMITATION OF LIABILITY

14.1 Unless by any negligence or breach of duty by the Company, the member is responsible for any loss, theft, injury or damage to property.

14.2 The Company only accepts liability for death or personal injury to the extent that it results from negligence by the Company.

PHYSICAL HEALTH OF MEMBER
15.1. The member warrants and represents that they are in good health and are not knowingly incapable of engaging in the classes they attend or the exercise programmes they follow and such classes and exercises would not be detrimental to the health, safety, comfort, wellbeing or physical condition. If in doubt the member should consult their GP.

15.2 The member is responsible for monitoring their own physical condition and should any unusual symptoms occur they must immediately inform their instructor or a member of staff and refrain from further participation in the class or exercise.

ASSIGNMENT
16.1 Members cannot sell, assign or transfer their membership.

16.2 The Company may assign the rights, obligations and benefits of this agreement to another organisation. Members will be notified in advance of any such assignment. Members rights will not be affected.

TERMINATION OF CONTRACTED MEMBERSHIPS BY THE MEMBER
17.1 All Memberships have a specified time period and cancellation policy contained within the member joining materials.

17.2 Any Membership subscription will continue to be collected after the minimum period until cancelled by the member. Should you not wish to continue subscribing after the minimum period, you must give notice to cancel the contract at least one month before the final payment of the minimum period. If you wish to cancel the contract at any time after the minimum period, you must give at least one month's notice. The notice should be in writing to The Memberships Team, The Isabel Blackman Centre, Winding Street, Hastings, East Sussex, TN34 3AT.

17.3 The member is responsible for cancellation of the direct debit with their bank, after the final direct debit payment has been collected.

17.4 In the event of termination, any fees paid in advance will not be refundable.

TERMINATION OF MEMBERSHIP BY THE COMPANY
18.1 Without notice and with immediate effect the Company may cancel membership if the member’s conduct may be injurious to the name, character or interests of the Company or such that it renders the member unfit to associate with other members or use the facilities of the Centre. No refund will be due to the member.


GOVERNING LAW AND JURISDICTION OF THE COURTS
19.1 This agreement shall be governed and construed in accordance with English Law and the Company and the member agrees to submit any dispute to the exclusive jurisdiction of the English Courts.

19.2 Each of the paragraphs in these Terms & Conditions operates separately. If any Court or relevant authority decides that any of them are unlawful the remaining paragraphs will remain in force.

DATA PROTECTION
20.1 Information collected from a member will be added to the Company’s membership database. The Company may use this for administrative purposes in providing the services, and for communication with the member. In compliance with the Data Protection Act 2018 all information will be treated as confidential and will not be shared with any other organisation without the explicit and informed consent of the member.
